The Buckley and Mann site foundation area has been used by the Town's contractor for the Lawrence Street improvements project since the project began in September 2018. Drone images 2/3/19 show materials staged and construction activity. These foundations and nearby soils will be tested as part of the Phase II Scope of Work. Residents opposed the use of this site and in November of 2018, the DEP responded that the use of site was allowed until the testing showed contaminants above reportable concentrations. However, the environmental testing done in January of 2019 has not been made public and PIP group has requested all results be disclosed. One of the concerns raised by PIP Petitioners was the condition of the waters of Bush Pond. This image taken 2/3/19 shows there were tests done and results are pending. A request was made on 2/25/19 for a Status Update PIP Meeting and again on 3/18/19 with 26 signatures to present all of Mabbett's test results to date. The results of Mabbett's testing are important and the DEP will have to determine what comes next since the Lawyer for Buckley and Mann has declined to make test results available at this time.
