7/26/18 Bridge Bid Opening at Town Hall

7/31/18 DEP Issues Superseding Order of Conditions with one addition of compensatory flood storage as cited in Appeal. No other changes were made. The DEP states the Project is "not within the AUL boundary". Note the AUL has been terminated with documented contamination OUTSIDE the old AUL boundary. The DEP states that Project proponent (town) states that “should evidence of contaminated material be encountered during planting of wildlife mitigation plant materials, work will be stopped and the appropriate remedial actions will evaluated.” Without proper testing for contamination, how does one "encounter" contamination? The DEP documented the Termination of the AUL. There are exceedances to MCP standards for heavy metals found outside the AUL boundary which have also been filed with the DEP. The Town of Norfolk has hired an LSP to look at the site. A complete horizontal and vertical extent of contamination is pending.

These issues have been forwarded to DEP Waste Site Cleanup and wetlands issues are no longer pending.
